The Ethics of Influencers

About the Program:
Using Influencers has become one of the hottest trends in marketing. In 2018, 81% of marketers reported that using influencers as part of their marketing plan was an effective strategy. But there are all sorts of ethical issues associated with this trend that must be understood and carefully addressed. For example, there is the issue of inauthentic partnerships and content, as influencers do not always use or even like the products they endorse on social media. Similarly, influencers do not always disclose if a certain recommendation is a sponsored endorsement or not (a 2018 survey of influencers done by Marketer demonstrated that less than half of the respondents labeled their endorsements with the FTC-mandated hashtags when they are specifically asked, and 7% never did so at all). This Ethics of Influencers event will cover these, as well as other issues, and include a general discussion on the ethical implication of digital marketing technologies.
Nizan Geslevich Packin is an Associate Professor of law at the Zicklin School of Business, Baruch College, City University of New York, and an affiliated faculty at Indiana University’s program on Governance of the Internet & Cybersecurity. Nizan’s research focuses on issues relating to financial regulation, consumer protection, information law, emerging technologies, and innovation. Before joining Zicklin in 2013, she practiced law for six years at Skadden, Arps, Slate, Meagher & Flom LLP, in the Banking and Corporate Restructuring groups. Prior to Skadden, she externed for Judge Jack B. Weinstein in the Eastern District Federal Court of New York, interned at the Federal Trade Commission, and served as a law clerk in the Israeli Supreme Court.
Nizan has written multiple op-eds on tech policy and consumer finance related issues for the Wall Street Journal, American Banker and Newsday, and publishes regularly in Forbes, where she serves as a Contributor. She has also published articles, book chapters and book reviews in journals such as the (i) American Bar Association’s; (ii) Indiana Law Journal, (iii) Washington University Law Review, (iv) Houston Law Review, (v) William and Mary Law Review, (vi) Columbia Business Law Review, (vii) Harvard Law School Corporate Governance Forum, and (viii) the Oxford Business Law Blog.

Gil is an accomplished public speaker, and has delivered keynotes at notable influencer marketing conferences, including Influencer Marketing Days in New York and Influencer Marketing Hub in London. Gil was recently selected as the 2017 recipient of the Digiday Top Boss Award in the technology industry, as well as one of 40 must follow digital media influencers. Gil has an MBA from the Kellogg School of Management at Northwestern University, as well as a Bachelor of Laws from Bar-Ilan University in Israel.
